Question: Does a participant need to provide full-time (24 hrs/day) care for an ill household member to qualify for a Code 07 exemption? |

Answer: No, a participant is eligible for a Code 07 exemption if the following requirements are met:
- The participant's presence is required because of the physical or mental impairment of another member of the same household.
- The CW 61 or medical documentation indicates that the ill household member is physically or mentally disabled, and the participant is needed in the home to provide care.
- The participant’s caretaking responsibilities impair his/her ability to regularly work or participate in WtW activities.
- The participant is the only adult able to provide care, which is stated on the PA 853 affidavit.

Question: Can a Code 07 exempt participant work or participate in WtW activities as an Exempt Volunteer? |

Answer: Yes. For example, the participant is needed in the home to care for a disabled child for 25 hours per week and also works 9 hrs/wk.
Note: If the participant can work or participate in WtW activities for at least 32/35 hours per week, then his/her caretaking responsibilities do not prevent him/her from regularly participating, so a Code 07 exemption will not apply. |

Question: Is a participant eligible for a Code 05 exemption if the CW 61 indicates a participant is disabled, but able to participate part-time in WtW activities (i.e. 10 hrs/wk training activity)? |

Answer: Yes, if the participant meets the following requirements, a Code 05 exemption can be granted:
- The disability is expected to last at least 30 calendar days.
- The disability significantly impairs the individual’s ability to be regularly employed or participate in WtW activities.
- The participant is actively seeking medical treatment.
- The CW 61 or medical documentation includes the above information.

Question: If the CW 61 indicates a Code 05 exempt participant can attend school for 12 hrs/wk, can we require him/her to participate the 12 hrs/wk? |

Answer: No. Even though the CW 61 indicates the participant can attend school for 12 hrs/wk, he/she was granted a Code 05 exemption. He/she can either choose to take the exemption or volunteer in GAIN. As an exempt volunteer, he/she is not required to meet a minimum number of participation hours. |

Question: Can an aided parent be exempt from GAIN if he/she resides with an unaided stepparent who is employed full-time? |

Answer: No. An unaided stepparent cannot meet the work requirements of an aided parent. In this scenario, the exemption request is denied because the stepparent is not included in the CalWORKs assistance unit. |
