Ancillary Expenses

9/30/09 1.
Question:  If a participant is receiving student financial aid that pays for an educational expense of a specific item or service (e.g.., book voucher for a required textbook), can the participant also be reimbursed or advanced an ancillary payment for the same specific item or service?
   

Answer:  No.  A participant is not eligible to receive a reimbursement or advance payment for a specific item or service that is specifically covered under a student’s financial aid.  Duplication of supportive services payments is to be avoided.

Note: Per Manual of Policies and Procedures (MPP) Section 42-750.332, counties cannot deny or reduce welfare-to-work supportive services if a participant indicates that financial aid is not available to meet his/her supportive services needs.

Question: Can supportive services for ancillary payments be advanced to the participant?
   

Answer:  Yes, MPP Section 42-750.21 states that payments for supportive services (except child care as described in Chapter 47-100), shall be advanced to the participant when necessary and desired by the participant so that the participant need not use personal funds to pay for these services.

Question:  A participant became employed during Job Club and used a photocopy of his lost Permanent Resident Card (Green Card) as proof of his permanent resident status.  However, the employer is now requesting to see the original card.  Is the fee to replace a lost or stolen Permanent Resident Card (Green Card) covered under ancillary expenses?
   

Answer:  Yes.  The fee to replace a lost or stolen Permanent Resident Card (Green Card) is an allowable ancillary expense payment if the card is needed to obtain/retain employment.  Ancillary/work-related payments may be issued when "necessary to obtain/retain employment." 

Before payment is authorized, documentation of need and cost must be verified and clearly documented on MGPA (Chapter 1200, Section 1232.2).  A current employment verification verifying the employment or a commitment to hire letter (e.g., a participant's hire is pending verification of possessing a valid Permanent Resident Card) can be used as documentation to establish the need.  Information on the current cost to replace a lost or stolen card can be obtained from U.S. Citizenship and Immigration Services (http://www.uscis.gov/portal/site/uscis ).

Also, as with all other ancillary expense issuances, documentation of purchase applies (Chapter 1200, Section 1232.7).

Question:  Do ancillary expenses cover the fee to replace a lost or stolen Permanent Resident Card (Green Card) needed to participate in Job Club, to provide proof of permanent resident status during their job search/job interviews? 
   

Answer:  Yes.  The fee to replace a lost or stolen Permanent Resident Card (Green Card) is an allowable ancillary expense payment if the card is required/needed to successfully participate in a Welfare-to-Work activity (e.g., Job Club, Work Experience). 

Before payment is authorized, documentation of need and cost must be verified and clearly documented on MGPA (Chapter 1200, Section 1232.2).   Information on the current cost to replace a lost or stolen card can be obtained from U.S. Citizenship and Immigration Services (http://www.uscis.gov/portal/site/uscis ).   Also, as with all other ancillary expense issuances, documentation of purchase applies (Chapter 1200, Section 1232.7).

Question:  Are ancillary expenses for self-employment covered?
   

Answer: Ancillary expenses do not cover the cost of starting-up a business.  The 40% disregard or actual verified expenses option selected in CalWORKs (Section CW 44-113.2) by self-employed participants covers the "ongoing cost of doing business" for the duration of their self-employment status.  The participant can change the method selected only at CalWORKs redetermination or every six months, whichever happens first, by contacting their CalWORKs Eligibility Worker.

An allowable ancillary expense for self-employed participants may be a fee as the initial cost to start self-employment (e.g., Contractor License Fee, State Licensing Fee).  However, the renewal cost (if required) would be considered as part of the "ongoing cost of doing business" and would not be an allowable ancillary expense.

Question:  A participant entered GAIN in April 2007 and his/her SIP was approved.   The participant submitted an ancillary reimbursement request along with receipts for items purchased in February 2007 for the Spring 2007 semester.   Can the ancillary reimbursement request be denied because the purchases occurred prior to the GAIN contract for his/her approved SIP?
   

Answer:  No.  Since the participant was in an approvable SIP for the Spring 2007 semester, if the need is established for items purchased for the Spring 2007 semester and receipts were provided to support/verify the purchases, he/she is entitled to the reimbursement.

A participant in an approved SIP is eligible to ancillary expenses (Chapter 1230, Section 1232.11).  If documentation of need and cost to support an ancillary request are verified, ancillary payments can be issued as a reimbursement (Chapter 1230, Section 1232.16).

Question:  How often can a participant request ancillary expense payments for clothing to attend Job Club?

   

Answer:  There is neither a cap nor a limit on the number of ancillary expenses that can be issued for clothing to attend Job Club. If it is established that the requested clothing is needed for participation, the request shall be authorized. Recent issuance(s) for Job Club clothing may be reviewed and discussed with the participant when evaluating subsequent requests. 

For example, if a participant is rescheduled for Job Club due to a "no show" or was "dropped’ and he/she received a clothing issuance for the initial Job Club assignment, the previous issuance may be reviewed.  The previous clothing issuance is reviewed with the participant and the new request authorized as appropriate, if the participant has good cause (e.g., participant no longer has the clothing purchased due to an eviction/homelessness, domestic violence).

QuestionIs it necessary to wait for Job Club to submit a request for clothing on behalf of the participant (e.g., GN 6007) before payment can be issued?  
   
Answer: No. When negotiating contracts for Job Club, participants are informed of the need to dress in business attire.  In addition to discussing supportive services with a participant, an assessment of his/her clothing needs must be conducted.
